N423bn probe case: El-Rufai reports judge to CJ, alleges bias

Former Governor Nasiru Ahmad El-Rufa’i of Kaduna State has filed a petition with the Chief Judge of the Abuja Federal High Court, accusing Justice Rilwan M. Aikawa of bias in his case against the Kaduna State House of Assembly.

In the petition submitted through his counsel, Abdulhakeem Mustapha, SAN, El-Rufa’i claimed bias, injustice, and denial of a fair hearing. He requested that the case be reassigned to another judge to ensure justice.

The petition states: “The Applicant filed this suit to enforce his Fundamental Human Rights to fair hearing against the Respondents on June 26, 2024, at the Federal High Court, Kaduna Division. The case was assigned to Honourable Justice R.M. Aikawa, who scheduled it for hearing on July 8, 2024.”

“At the hearing on July 8, 2024, S.S. Umoru, Esq appeared for the Applicant, while Sani Katu, SAN represented the 1st Respondent, and Sule Shuaibu, SAN, the Honourable Attorney-General of Kaduna State, appeared in person for the 2nd Respondent. Umoru, Esq. informed the court they had been served with the 2nd Respondent’s processes and were within the time to respond. However, the Learned Silk for the 1st Respondent stated they had not filed any processes and were one day out of time.”
